THIS RELEASE IS A BINDING LEGAL CONTRACT, PLEASE READ IT CAREFULLY.
IN ORDER FOR YOU TO PARTICIPATE IN ANY ACTIVITIES IN ANY WAY CONNECTED TO ADRENALINE CLIMBING, LLC YOU MUST CERTIFY THAT YOU AGREE TO THE TERMS CONTAINED HEREIN:
I hereby declare my intention to participate in activities within the Adrenaline Climbing facility (the “Facility”) located at 460 Brogdon Road, Suite 100, Suwanee, Georgia 30024, and/or participate in outdoor instruction and/or expeditions (the “Trips”) sponsored by or involving Adrenaline Climbing, LLC., and/or participating in other activities sponsored by or involving Adrenaline Climbing. In consideration for Adrenaline Climbing allowing me to use the Facility, participate in the Trips, and/or participate in the other activities, I agree to be bound by the terms and conditions of this Release of Liability and Assumption of Risks (the "Release"). I further agree to indemnify, hold harmless and defend Adrenaline Climbing from and against any loss, damage, liability and expense, including costs and attorneys’ fees, incurred by Adrenaline Climbing as a result of me using the Facility, participating in the Trips, and/or participating in any other activity sponsored by or involving Adrenaline Climbing.
I acknowledge that using the Facility, participating in the Trips and participating in other activities sponsored by Adrenaline Climbing involves certain inherent risks, including the risk of death or serious personal injury. I agree to assume all such risks, as well as any other risks involved in using the Facility, participating in the Trips or participating in any other activity sponsored by or involving Adrenaline Climbing. I also agree to release and discharge Adrenaline Climbing and all of its employees, agents, representatives, volunteer staff, their heirs, executors, and administrators, as well as all other persons, corporations or other entities that might have any liability to me (the "Released Parties"), from and against any and all damages, actions, claims and liabilities, whether known or unknown, anticipated or unanticipated, suspected or unsuspected, relating to or arising from any activity, occurrence or event involving the facility, and/or the Trips of Adrenaline Climbing.
This Release is intended to release and discharge the Released Parties from all damages, actions, claims and liabilities of any nature, specifically including, but not limited to, damages, actions, claims and liabilities arising from or related to the negligence of the Released Parties. I further agree to indemnify, hold harmless and defend Adrenaline Climbing from and against any loss, damage, liability and expense, including costs and attorneys’ fees, incurred by Adrenaline Climbing as a result of my using the Facility, participating in the Trips or participating in any activity sponsored by or involving Adrenaline Climbing. I hereby voluntarily waive any right I may have to a trial by jury in any action, proceeding or litigation involving any Released Party.
The laws of the State of Georgia shall govern the rights and obligations of the parties to this Release and the interpretation, construction and enforceability thereof. I agree that any lawsuit brought against any Released Parties shall be brought solely in Gwinnett County.
In addition, I understand that wearing a helmet while climbing in the Facility is not required, as is customary in the climbing gym industry. I understand that I can rent a helmet from Adrenaline Climbing. If I choose not to wear a helmet while climbing and/or belaying at the Facility, I agree to assume all risk of personal injury and death that may occur as a result of not wearing a helmet. I understand that I will be required to wear a helmet while climbing and/or belaying on any Adrenaline Climbing Trip.
In the event of an accident, if I should be unconscious or otherwise unable to make medical decisions for myself, I hereby grant the Released Parties permission to administer necessary first aid, and/or to solicit emergency medical services as deemed necessary. This authorization includes permission for emergency medical transportation to the nearest medical facility for additional medical treatment.
Adrenaline Climbing reserves the right to use any photograph taken at the Facility, on any Trip, during any indoor or outdoor workshop, during any private event held at the Facility or otherwise involving Adrenaline Climbing, or at any event otherwise sponsored or involving Adrenaline Climbing. Such images may be used in Adrenaline Climbing’s promotional materials, brochures and/or website.
